Grupo Conexión Software, S.A.P.I. de C.V. (“Leadsales”) hereby informs you and shares its Privacy Notice (the “Privacy Notice”), detailing the way in which we safeguard the integrity, privacy, and protection of your Personal Data (as this term is defined below), in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its regulations, guidelines, and other related and applicable provisions (hereinafter, collectively referred to as the “Law”).

Through this document, Leadsales makes its Privacy Notice available to you regarding the Personal Data of individuals whose personal data Leadsales will collect, access, and process.

In addition to other definitions included throughout this Privacy Notice, the terms listed below shall have the meanings ascribed to them in each case:

“Client” means the User who holds an account and has made a subscription payment.

“Personal Data” means any information related to an identified or identifiable natural person.

“Leadsales” means Grupo Conexión Software, S.A.P.I. de C.V.

“Platform” refers to the software owned by Leadsales, through which it provides various services.

“Services” means the technology services offered by Leadsales to Clients and Users to facilitate their contact with third parties, such as the Client’s customers and/or prospects, through the interconnection of digital platforms, in order to enhance the Client’s customer service, sales, and/or advertising efforts.

“Holder” or “Holders” refers to the owners of the Personal Data provided to Leadsales who, for the purposes of this Privacy Notice, may be either Clients or Users.

“User” means any person who accesses, interacts with, and/or uses the website or the Platform.

1. IDENTITY AND ADDRESS OF THE CONTROLLER

Leadsales will be responsible for the processing of Personal Data provided by Clients and Users in accordance with the Law and designates the following address for the purposes of this Privacy Notice: Héroe de Nacozari 25B, Col. Centro, Querétaro, Querétaro, C.P. 76000, with RFC GCS210625N84. 

 

1. PURPOSE

The purpose of this Privacy Notice is to define the scope and general conditions of Leadsales‘ processing of the Personal Data provided by Clients and Users and to inform the Holders thereof, enabling them to make informed decisions regarding the use of their Personal Data and to maintain control and disposition over them. Additionally, through this Privacy Notice, Leadsales ensures transparency in such processing, thereby seeking to strengthen the Holders’ level of trust.

 

III. PERSONAL DATA COLLECTED

 

Leadsales informs you that the Personal Data provided by Clients and Users is treated with strict confidentiality, always respecting the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and responsibility, as established by the Law.

To comply with this Privacy Notice, ensure the proper provision of our professional services, and facilitate the correct use of the website www.leadsales.io and the Platform, Leadsales may collect, request, and store the Personal Data of Clients and Users in various situations through the following means: (i) Directly, when the Holder provides them through electronic means such as emails, digital forms, text messages, digital platforms like social media, or the submission of multimedia files; (ii) Through the use of the website www.leadsales.io and/or the Platform; or
(iii) Directly and physically provided by the Holder to Leadsales and/or its collaborators through physical documents such as satisfaction surveys and/or forms.

The Personal Data that we may collect, including but not limited to, as applicable to the specific case, are the following:

  • Identification Data: full name, address, date of birth and/or age, nationality, Unique Population Registry Code (CURP), business sector, landline and/or mobile phone number, email address, full name of the legal representative, and documents proving such representation, if applicable.
  • Billing Data: name or business name, tax address, Federal Taxpayer Registry (RFC) registration key, or tax identification number.
  • Financial Data: bank account information, payment method, and payment receipts.

 

1. PURPOSES AND/OR USES OF PERSONAL DATA

The Personal Data provided by the Holder(s) through service contracts, information requests, and/or forms created and collected by Leadsales will be used for the following purposes:

PRIMARY PURPOSES:

  1. To offer, promote, and provide Leadsales‘ Services.
  2. To verify the authenticity of the information provided by the Holders for the proper provision of the Services.
  3. To compile records and databases necessary for the provision of the Services to be contracted, as well as to fulfill the obligations arising from such contracts.
  4. To maintain communication with Clients and Users, as well as to notify them of any changes in the conditions of the contracted or to-be-contracted Service.
  5. To establish a business, commercial, and legal relationship with Clients and Users.
  6. To conduct service satisfaction surveys;
  7. To provide guidance, clarifications, respond to comments, suggestions, and complaints, as well as offer support assistance and/or customer service;

 

SECONDARY PURPOSES:

Additionally, Leadsales may process your Personal Data for:

  1. To send Clients and/or Users information regarding offers and promotions of the Services.
  2. To obtain usage statistics of the website and the Platform to provide a better experience for Clients and Users.
  3. To conduct statistical and marketing analyses.

If the Holder does not wish for their Personal Data to be processed for these additional purposes, they may notify their objection by sending an email to [email protected], stating their request.

 

1. CUSTOMER PROSPECTING

Leadsales, in order to offer its services to Users or prospective Clients, provides the option to conduct service demonstration sessions via video call with such Users or prospective Clients. These calls may be recorded for service quality purposes unless the Client expressly requests at the beginning of the call that the recording not be carried out.

To access the service demonstration sessions, the User or prospective Client must first accept this Privacy Notice, thereby granting their express consent for the processing of their personal data under the terms outlined in this document.

 

1. MINORS AND INCAPACITATED PERSONS

The Services are available only to individuals who have the legal capacity to contract them. Therefore, individuals who do not possess such capacity, including but not limited to minors, cannot contract the Services or use the Platform. For this reason, Leadsales does not process data in such cases.

 

VII. USE OF TRACKING TECHNOLOGIES

 

The website and the Platform use “cookies” and “server logs” to collect certain non-personal information. This information is obtained simply by using and interacting with our website or Platform and may include Internet Protocol (IP) addresses, operating system, browser type, location information (provided by mobile devices), and the navigation path the Holder follows while browsing our site.

This data is collected solely for the following purposes: to generate statistics related to visits to our website, the time spent on it, and the referring sites that may have led users to ours. This information is also used to maintain and update User and/or Client profiles to tailor or personalize the information provided through this medium.

Each Client or User can accept or reject the use of cookies through the settings on their smartphone or computer. However, it is important for Users to be aware that if they do not accept the use of cookies, some functions of the Platform may not be fully available, as certain Services offered by Leadsales are only accessible through the use of cookies.

 

VIII. TRANSFER OF PERSONAL DATA

 

In order to fulfill the obligations arising from the legal relationship we maintain with Clients and/or those derived from the provision of contracted services with them, Leadsales may process Personal Data as necessary Leadsales, as well as for the purposes outlined in this Privacy Notice, Leadsales it may transfer, without requiring the Clients’ consent, the necessary Personal Data to third parties involved in the provision of the Services when the transfer is necessary under a contract entered into in the interest of the Holder of the Personal Data, in accordance with Leadsales and such third parties, who will be required to comply with the provisions of this Privacy Notice. Leadsales will ensure, through the signing of agreements and/or the adoption of other binding documents, that these third parties maintain appropriate security, administrative, technical, and physical measures to safeguard Personal Data and that they use the Personal Data solely for the purposes for which it was collected.

Notwithstanding the foregoing, Leadsales may at any time disclose and transfer Clients’ and Users’ Personal Data when required by law and/or a competent authority or when it believes in good faith that such disclosure is necessary to: (i) comply with legal proceedings; (ii) respond to claims involving any content that infringes on the rights of third parties; (iii) protect the rights, property, or safety of Leadsales, its Users, and the general public; and (iv) when the transfer is provided for by a law or treaty to which Mexico is a party.

Leadsales may provide Clients’ and Users’ Personal Data to any authority that requests it, in order to pursue any legal defense on its behalf, establish protective measures against illegal activities or situations that pose a risk to the safety of any person, and for any other activity required by law or any authority.

 

1. ACCESS TO PERSONAL DATA IN SUPPORT ASSISTANCE

In accordance with the primary purposes outlined, Leadsales offers its Clients the option of support assistance to address any questions they may have regarding the functionalities and configuration of the Platform, as well as the Services in general. For this purpose, Leadsales‘ assigned support staff may access the Client’s account. As part of this support function, Leadsales personnel may be exposed to viewing Personal Data of the Client’s own customers and/or prospects. Similarly, as part of the support services, Leadsales personnel may access the Client’s account to ensure that the Client is making the most efficient use of the available features on the Platform, providing recommendations on optimizing its use.

In such cases, the viewing of Personal Data of the Client’s customers and/or prospects will be considered indirect access to Personal Data, subject to this Privacy Notice. Leadsales does not carry out actions related to the storage, management, or use of the Personal Data accessed by its personnel during support assistance activities.

 

1. MEANS TO EXERCISE ARCO RIGHTS

Leadsales will strive at all times to ensure that Personal Data is relevant, accurate, and up to date for the purposes for which it was collected. The Holder of the Personal Data provided to Leadsales is responsible, in any case, for its truthfulness, accuracy, validity, and authenticity and commits to keeping it properly updated with Leadsales.

As the Holder, or through your legally accredited representative in accordance with applicable common law, you may exercise your rights of Access, Rectification, Cancellation, or Opposition (“ARCO Rights”), which are described below for easy reference:

Access: The Holder shall have the right to access their Personal Data held by Leadsales, as well as to be informed about the conditions and general aspects of its processing.

Rectification: The Holder shall have the right to request Leadsales to rectify or correct their Personal Data when it is inaccurate, incomplete, or not up to date.

Cancellation: The Holder shall have the right to request the cessation of the processing of their Personal Data by Leadsales, starting with the blocking of such data and its subsequent deletion.

Objection: The Holder may object to the processing of their Personal Data or demand its cessation.

To exercise ARCO Rights, the Holder must submit the corresponding request by sending an email to [email protected] on business days from Monday to Friday, between 09:00 and 18:00 hours.

For this purpose, the Holder must clearly and precisely inform Leadsales of the Personal Data they wish to have rectified, canceled, or reviewed. In general, their request must comply with the requirements mentioned in Article 29 of the Law:

  1. Full name of the Holder, address, or email where they wish to receive information related to the procedure;
  2. Documents proving their identity or the legal representative’s authority to act on behalf of the Holder;
  3. A clear and precise description of the Personal Data for which the right of Access, Rectification, Cancellation, or Objection is being exercised, as applicable; and
  4. Any document that facilitates the location of the Personal Data.

 

Once the complete and duly integrated request is received, Leadsales will, within a maximum period of 20 business days from the date the request was received, communicate the corresponding resolution, determining whether the request is admissible or not. If deemed viable, the resolution will be executed within 15 days following the date the response is communicated.

If Leadsales is required to provide documentation as a result of the exercised right, it will do so through copies sent to the Holder via email or made available at the address specified by the Holder, within the aforementioned timeframe.

At all times, Holders may revoke the consent they have granted to Leadsales for the processing of their Personal Data. However, such processing cannot be stopped when Leadsales is legally required to continue handling the data. Additionally, it should be noted that for certain purposes, revoking consent may result in Leadsales being unable to continue providing the service and/or assistance, or it may lead to the termination of the relationship with Leadsales.

 

1. WHAT MEASURES ARE USED TO PROTECT PERSONAL DATA?

Leadsales has implemented and maintains administrative, physical, and technical security measures to protect the Personal Data of its Clients and Users against damage, loss, alteration, destruction, or unauthorized use, access, or processing. Additionally, it ensures that the data is properly safeguarded and kept up to date for the purposes for which it was collected.

 

XII. SCOPE AND APPLICATION

 

Este Aviso de Privacidad es aplicable a todos los Titulares, tanto a los Usuarios, Clientes, proveedores y aliados comerciales, así como a cualquier otra persona física o moral que tenga interés o injerencia en la prestación de servicios por parte de Leadsales, aplicando a sus diferentes interacciones.

 

XIII. MODIFICATIONS TO THE PRIVACY NOTICE

 

Leadsales reserves the right, at its sole discretion, to change, modify, add, or remove portions of this Privacy Notice at any time. In such cases, Leadsales will make the modifications or changes available through the following means: (i) on our website: www.leadsales.io; or (ii) via a notice sent to the last email address provided, indicating the date of the latest version of the Privacy Notice.

The continued use of the services will be understood as the Client’s acceptance of the changes made to the Privacy Notice.

By providing their Personal Data to Leadsales, the Holder expressly states their agreement with the collection, use, storage, and processing of their Personal Data, including the possible transfer of such data. Therefore, they give their explicit consent to comply with the provisions set forth in this Privacy Notice.
